Gaffney Mullins & Co Solicitors recently acted in High Court cohabitation proceedings and were delighted to resolve the matter for our client at an early stage in the proceedings.
Cohabitation is governed by the Civil Partnership and Certain Rights and Obligations of Cohabitants Act 2010. This Act provides certain rights to unmarried couples who live together in an intimate and committed relationship and who may or may not have children. If the relationship breaks down, a party may be able to seek similar orders that a married couple may obtain via a divorce, if there is financial dependency. A party must apply within 2 years of the relationship ending to seek orders.
In this case, it was disputed that the couple were a qualifying cohabiting couple and financial dependency was also disputed. Following financial disclosure and an exchange of Affidavits, the case was resolved via settlement talks which avoided the necessity for a potentially costly Hearing.
